Terms of Use
These Terms of Use govern your use of simmr. They work together with our Privacy Policy, which explains how we handle your personal data; please read both before using the app.
1. Agreement & definitions
These Terms of Use ("Terms") are a binding agreement between you and Emmanuel Janssens, trading as Nest Apps ("Nest Apps", "we", "us"), and govern your use of simmr and any other application we publish under the Nest Apps name. simmr is currently our only published app; references to "the App" mean simmr unless we say otherwise. Nest Apps is established in Switzerland; our registered address is [ADDRESS — set before publishing].
By installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App. If you use the App on behalf of a household or other group, you confirm you are authorised to accept these Terms for that use. These Terms work together with our Privacy Policy, which explains how we handle your personal data; please read both.
1.1 Definitions
- App — the simmr mobile application (meal planning, pantry, shopping and cooking features), including all updates, and any other application we publish under the Nest Apps name.
- Account — the user account you use to access the App. You may start as a guest (no email) and later convert to a full account with an email and password, or sign in with a Google or Apple identity. Your Account gives you access to your household Group and the data shared within it.
- Group — a household workspace. Recipes, meal plans, pantry items, shopping lists, photos and certain other content are scoped to a Group and are visible to its members. A Nest Plus subscription is shared across the Group it is assigned to.
- Subscription — a paid Nest Plus plan, offered as an auto-renewing monthly or yearly subscription. The separate BYOK unlock is a one-time, one-off purchase rather than a subscription. All billing, renewals, cancellations and refunds are handled by the Google Play Store or the Apple App Store; we do not process or see your payment-card details. Subscriptions and the BYOK unlock are described in Section 7.
- Content — the material you create, import or upload through the App, including recipes (with their instructions, ingredients, tags and source links), meal plans, pantry and shopping-list items, custom ingredients, prep plans, photos you capture or import, and feedback you submit. You retain ownership of your Content, subject to the licence you grant us to operate the service (see Section 5).
- BYOK ("bring your own key") — an optional mode, unlocked by a one-time purchase, that lets you supply your own large-language-model API key (for Claude or another OpenAI-compatible provider you configure, including a local or self-hosted endpoint) so that AI recipe-import and planning requests are sent directly from your device to your chosen provider. Your key is stored only on your device and is never sent to our servers. You are responsible for your provider account, usage and costs. Note that for importing a recipe from a web link, the link is still fetched through our servers even in BYOK mode. BYOK is described further in Section 6.
2. Eligibility
simmr is a household meal-planning and pantry app. By creating an account or otherwise using simmr, you confirm that you meet the requirements set out in this section. If you do not meet them, please do not use the app.
2.1 Minimum age
You must be at least 13 years old to use simmr. If you live in the European Economic Area or the United Kingdom, you must be at least 16, or the minimum age required for us to provide an online service to you without parental consent in your country if that age is higher. simmr is not directed at, and we do not knowingly allow accounts for, anyone below these ages. This mirrors the children's section of our Privacy Policy; if you believe a child has created an account or provided us data, email admin@nestapps.ch and we will remove it.
2.2 Capacity to contract
You must have the legal capacity to enter into a binding agreement with us. These Terms form a contract between you and Emmanuel Janssens, trading as Nest Apps. If you are using simmr on behalf of a household or other group, you confirm that you are authorised to do so and that each member you invite is also eligible under this section. If you are below the age of majority in your country but old enough to use simmr under section 2.1, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2.3 One account per person
simmr accounts are for individual people. Each account must be registered and used by a single human being; you may not share your account with others or create an account on behalf of someone who is not eligible. You may, however, join a shared household group with other eligible people, and a Nest Plus subscription can be shared across the members of your group. You are responsible for keeping your login credentials secure and for activity that happens under your account.
3. Your account
3.1 Creating an account
To use simmr you create an account, either with an email address and password, by signing in with Google or Apple, or as a guest. You agree to provide accurate information and to keep it up to date, in particular a valid email address where one is required, so we can reach you about your account, security, or billing.
A guest account has no email or password attached. It exists only on the device where it was created until you convert it to a full account, and we have no way to recover it or restore access if you lose that device, sign out, or uninstall the app. Convert your guest account if you want it to be recoverable and usable across devices.
3.2 Keeping your account secure
- Keep your password and any sign-in credentials confidential and do not share them. You are responsible for all activity that happens under your account.
- If you bring your own AI provider key (see Section 6), that key is stored only on your device and is yours to safeguard.
- Tell us promptly at admin@nestapps.ch if you believe your account has been accessed without your permission.
3.3 Groups and household sharing
simmr is built for households. When you create or join a group, the recipes, meal plans, shopping lists, pantry items, photos, and feedback in that group are visible to, and editable by, every member of the group, and a Nest Plus subscription applies to the whole group rather than to a single person.
- Only add people to your group whom you trust with the group's content, and only join groups you trust. Anything you add to a shared group can be seen and changed by the other members.
- If you administer a group, you are responsible for managing its membership, including removing members who should no longer have access. Deleting a group permanently removes the content stored in it for everyone.
- Do not add other people, or content about other people, to a group without the right to do so.
3.4 Suspension and termination
We may suspend, restrict, or terminate your account, or remove content, if we reasonably believe you have breached these Terms, if your account is involved in abuse, fraud (including fraudulent or duplicate store purchases and chargebacks), or attempts to circumvent quotas, ads, or paid features, or where we need to do so to protect the service, other users, or the security and integrity of the platform. Where it is reasonable and lawful to do so, we will give you notice; we may act without prior notice where a delay could cause harm or where the law requires it. The detailed process is set out in Section 11.
4. Acceptable use & fair use
simmr is provided for personal, household meal-planning and pantry management. By using it you agree to use it lawfully and reasonably, and not to do any of the following.
4.1 Prohibited use
- Use the app for any unlawful, fraudulent, harmful, or abusive purpose, or in breach of any applicable law or regulation.
- Import, upload, store, or share content you do not own or have the right to use, or that infringes another person's intellectual-property, privacy, or other rights.
- Upload or transmit content that is unlawful, defamatory, hateful, or otherwise objectionable, or that contains malware.
- Harass, impersonate, or abuse other members of a shared household group, or access data belonging to a group you have not been invited to.
4.2 No scraping, reverse engineering, or automated abuse
- Do not scrape, crawl, harvest, or bulk-extract data from the app or our backend, or access the service through any automated means (bots, scripts) except as expressly permitted.
- Do not reverse engineer, decompile, or disassemble the app, or attempt to discover its source code, API keys, or server secrets, except to the limited extent such restriction is prohibited by applicable law.
- Do not probe, scan, overload, or otherwise interfere with the integrity, security, or performance of the service or its underlying infrastructure (including Supabase and our AI sub-processors).
- Do not abuse the recipe-import or URL-fetch features, or a bring-your-own-key (BYOK) configuration, to attack, overload, or send unauthorised traffic to third parties.
4.3 Fair use of AI import quotas and rate limits
AI-assisted recipe import and planning consume real compute and cost, so they are subject to fair-use limits. On the free tier, recipe import is capped by daily and monthly AI import quotas, and make-ahead prep generation is capped by a monthly limit. A one-time onboarding bonus scan may bypass the quota once. simmr Plus and BYOK change these limits. We may adjust quotas, rate limits, and which features they cover at any time for cost and abuse-control reasons.
- Do not circumvent, evade, or artificially inflate these quotas or rate limits, for example by creating multiple accounts, scripting requests, or manipulating onboarding to repeat a bonus scan.
- Do not use the service in a way that places an unreasonable or disproportionate load on it relative to normal personal household use.
4.4 No circumventing limits, entitlements, or store billing
- Do not bypass, disable, or tamper with paid feature gates, advertising, entitlement checks, or any other access controls in the app.
- Do not make fraudulent purchases or chargebacks, or attempt to obtain subscriptions, the BYOK unlock, or other entitlements without paying the applicable store charges. Purchases are validated against Google Play and the Apple App Store, and an anti-fraud check prevents a second account from claiming a purchase already linked to another account.
- Do not attempt to circumvent, spoof, or replay store billing, purchase tokens, or receipts.
We may investigate suspected violations and may, to the extent permitted by law, throttle, suspend, or terminate access to the service or to specific features, and remove offending content, where we reasonably believe these terms have been breached. If you believe enforcement was applied in error, contact us at admin@nestapps.ch.
5. Your content
"Your content" means everything you create, enter, or import into simmr, including recipes, recipe instructions and ingredient lists, meal plans, shopping lists, pantry items, custom ingredients, prep plans, and any photos you capture or upload for your recipes or pantry.
5.1 You own your content
As between you and Nest Apps, you keep all rights you have in your content. We do not claim ownership of it.
5.2 The licence you grant us
To run simmr for you, we need permission to handle your content. You grant Nest Apps a limited, non-exclusive, royalty-free licence to host, store, copy, back up, process, sync across your devices, and display your content, solely for the purpose of operating and providing the service to you and the members of your household group. This includes:
- sharing your content with the other members of any household group you belong to, so you can plan and cook together;
- transmitting recipe text and images you choose to import to our AI provider for parsing, normalisation, and prep planning, as described in our Privacy Policy; and
- making technically necessary copies (for example, backups and caching) to keep the service running.
This licence exists only to let us operate the service and lasts only as long as you keep the content in simmr; it ends when the content is deleted, except for copies we are required to keep by law or that remain in routine backups for a limited time.
Please note that recipe and pantry images you save are stored in a public-read storage bucket: anyone who has the image's (non-guessable) link can open it without signing in. Do not upload images you are not comfortable being accessible by link.
5.3 You are responsible for what you import
You are solely responsible for the content you add to simmr and for ensuring you have the right to add it. By importing or uploading content, you confirm that:
- you own the content, or otherwise have the necessary rights and permissions to use it and to grant us the licence above;
- where you import a third-party recipe (for example from a website, a photo, or pasted text), you are entitled to use that recipe for your own personal, household, non-commercial meal planning; and
- your content does not infringe anyone's intellectual-property, privacy, or other rights, and is not unlawful.
Nest Apps does not review or verify imported content and is not responsible for content you choose to add. You must not use simmr to copy, store, or redistribute content you have no right to use.
5.4 Feedback
If you send us feedback through the app, we may use it to operate, improve, and develop simmr without any obligation to you. Feedback you submit may be visible to other members of your household group.
6. AI features & accuracy disclaimer
simmr uses automated AI to make meal planning faster: it parses recipes you import from photos, web pages, or pasted text; normalises ingredients against your pantry; suggests make-ahead prep steps; and estimates unit conversions. These features are a convenience, not a source of professional advice. Read this section before relying on anything the AI produces.
6.1 AI output may be inaccurate or incomplete
Imported and parsed recipes, ingredient and quantity data, prep plans, unit conversions, and any nutrition-related information are generated automatically by AI models. They can be wrong, incomplete, out of date, or misinterpret the source. We do not manually review this output, and we do not guarantee its accuracy, completeness, or fitness for any particular purpose. Everything generated by AI is provided "as is" for your convenience only.
6.2 Not professional, medical, dietary, or allergen advice
AI-generated content is not professional dietary, nutritional, medical, or allergen advice, and it is not a substitute for it. You are responsible for verifying ingredients, quantities, allergens, and food-safety information yourself before you cook or eat anything, especially if you or anyone in your household has a food allergy, intolerance, dietary restriction, or health condition. Do not rely on simmr to identify or exclude allergens. If you have any doubt, check the original source and consult a qualified professional. To the fullest extent permitted by applicable law, we are not liable for any loss, harm, or damage arising from your reliance on AI-generated output.
6.3 Bring your own key (BYOK)
If you unlock the bring-your-own-key feature, simmr sends AI requests directly from your device to the provider you configure — Anthropic's Claude, or any OpenAI-compatible endpoint you choose, such as OpenAI, OpenRouter, or a local or self-hosted model. In that mode your own API key, account, usage, and any costs are entirely your responsibility, and your use of that provider is governed by that provider's own terms and pricing, not ours. We are not responsible for the availability, output, data handling, or charges of any third-party model you connect. Your key is stored only on your device and is never sent to our servers; one exception is recipe import from a URL, where the link you provide is still fetched through our servers even in BYOK mode. The accuracy disclaimers above apply equally to BYOK output.

7. Subscriptions, billing & refunds
simmr is free to use with a free tier, and offers an optional paid plan, Nest Plus, plus a separate one-time unlock for using your own AI provider key (see below). The sections below explain how paid purchases are billed, renewed, cancelled, and refunded.
7.1 Plans and what you pay for
- Free tier — core meal-planning, pantry, shopping, and cooking features, with limits on AI-assisted features (such as daily and monthly recipe-import quotas and a monthly prep-generation cap).
- Nest Plus — a paid, auto-renewing subscription offered on a monthly and a yearly billing period. Plus is applied to your household group, so members of the same group share the plan according to the available group slots.
- Bring-your-own-key (BYOK) unlock — where offered, a one-time, non-consumable purchase (not a subscription) that lets you use your own AI provider key. Because it is a one-off, it does not auto-renew.
7.2 Billing is handled by the app store
All purchases are sold, charged, and managed by the store you bought through — Google Play (Android) or the Apple App Store (iOS). Nest Apps does not process, receive, or store your payment-card or billing-account details; we only receive a confirmation from the store that a purchase is valid, so we can grant you the features you paid for across your devices.
7.3 Auto-renewal, cancellation & managing your subscription
- A Nest Plus subscription renews automatically at the end of each billing period, and your store account is charged for the next period, until you cancel.
- You can cancel at any time, and manage or change your subscription, in your store's subscription settings (Google Play or Apple App Store). The app provides a link out to the store's manage-subscription page. Cancelling stops future renewals; you keep Plus until the end of the period you have already paid for.
- Where a free trial or introductory offer is made available, its terms (including length and what happens when it ends) are set and governed by the store.
7.4 Refunds
Because billing is handled by the store, refunds are governed by the refund policy of Google Play or the Apple App Store through which you purchased, and refund requests must be made to that store. Nest Apps cannot directly issue, process, or guarantee a refund for a store purchase. This does not affect any mandatory withdrawal or refund rights you may have under applicable consumer law.
7.5 Price changes
We may change subscription prices for future billing periods. Where a price change affects an active subscription, you will be notified in accordance with the rules of the store, and — where the store requires it — the change will take effect only after you have been given the opportunity to review and, if you wish, cancel before the next renewal.
7.6 Taxes
Prices shown may be inclusive or exclusive of applicable taxes (such as VAT or sales tax) depending on your country and the store's settings. Any taxes are determined, collected, and remitted by the store as part of the transaction.
8. Our intellectual property
The simmr app and the wider Nest Apps service — including the software, source code, design, layout, user interface, graphics, logos, the simmr and Nest Apps names and branding, and all related text and content we provide — are owned by Emmanuel Janssens, trading as Nest Apps, or licensed to us by our suppliers. They are protected by copyright, trademark, and other intellectual-property laws.
Subject to your acceptance of and compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to download and use the app on devices you own or control, for your own personal, non-commercial household use. That is the only right you receive.
Except as expressly permitted by these Terms or by applicable law, you may not:
- copy, modify, adapt, translate, or create derivative works from the app or any part of the service;
- reverse-engineer, decompile, or disassemble the app, or attempt to derive its source code, except to the limited extent such restriction is prohibited by law;
- rent, lease, lend, sell, resell, sublicense, distribute, or otherwise commercially exploit the app or the service;
- remove, obscure, or alter any copyright, trademark, or other proprietary notices; or
- use our names, logos, or branding without our prior written permission.
This section does not affect the rights you keep in the content you create in the app (such as your recipes, meal plans, and photos), which are covered separately in Section 5. We do not claim ownership of your content.
No rights are granted to you beyond those expressly set out in these Terms. All rights not expressly granted are reserved by us and our licensors. If you have any questions about permitted use, contact us at admin@nestapps.ch.
9. Third-party services
simmr depends on services operated by other companies to run. We use these providers to host your data, sign you in, process payments, import and parse recipes, serve ads on the free tier, and monitor errors and crashes. They include Supabase (our backend, hosting and storage), Anthropic (the Claude AI used to parse imported recipes and generate prep plans), Google (Play billing, Sign-In, AdMob ads, and the User Messaging Platform consent form), Apple (App Store billing and Sign in with Apple), and Sentry (crash and error diagnostics). If you supply your own AI key (BYOK), you may also route recipe parsing to a provider you choose, such as OpenAI, OpenRouter, or a self-hosted endpoint.
Your use of these services through simmr is also governed by each provider's own terms and policies, in addition to these Terms. Where a provider's terms apply directly to you, you are responsible for reading and complying with them. This is especially true if you supply your own AI key under BYOK: you are responsible for that provider account, its costs, its usage limits, and its terms. For how data is shared with these providers and where it is processed, see our Privacy Policy.
9.1 No responsibility for third-party services
These services are operated by independent third parties that we do not control. To the extent permitted by law, we are not responsible for their availability, outages, errors, security incidents, pricing, or any change to or discontinuation of a third-party service, nor for content, results, or output produced by them. If a third-party service is unavailable or changes its terms, some features of simmr may be limited, degraded, or unavailable. Your use of a third-party service is between you and that provider.
9.2 Imported recipes and source websites
simmr lets you import recipes from external websites and other sources. Those source websites, their content, recipes, images, and trademarks remain the property of their respective publishers and owners. We do not own, endorse, or control that third-party content, and we are not responsible for its accuracy, availability, or legality. You are responsible for ensuring you have the right to import and use any content you bring into simmr, and you must not import content you have no right to use. A link to or import from a source site does not imply any affiliation, sponsorship, or endorsement.
10. Disclaimers & limitation of liability
10.1 Service provided "as is"
simmr is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we make no warranties or representations of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, secure, or available at any particular time, or that any defects will be corrected.
simmr relies on third-party services to function, including our hosting and backend provider (Supabase), AI providers used for recipe import and meal planning (Anthropic, or, if you supply your own key, the provider you configure), and the app stores and platform services that handle authentication, payments, and advertising (Google and Apple). We are not responsible for the availability, performance, acts, or omissions of these third parties, and an interruption or change to any of them may affect the service.
10.2 Automated and AI-generated content
As described in our recipe-import and planning features, imported and parsed recipes, generated make-ahead prep plans, ingredient and unit conversions, and any related information are produced by automated systems and may be inaccurate, incomplete, or out of date. They are provided for convenience only and are not professional, medical, dietary, nutritional, or allergen advice. You are responsible for verifying ingredients, quantities, allergens, and food-safety information yourself, especially where allergies, dietary restrictions, or health conditions are involved. We are not liable for any reliance you place on automatically generated content.
10.3 Limitation of liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, goodwill, or anticipated savings, arising out of or in connection with your use of (or inability to use) the service, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the service or these Terms is limited to the greater of (a) the total amounts you actually paid us, if any, for the service in the twelve (12) months immediately before the event giving rise to the claim, or (b) CHF 50. Because subscriptions and one-time purchases for simmr are billed through Google Play or the Apple App Store and not by us directly, amounts paid to those stores are determined by their records.
10.4 Your mandatory consumer rights are unaffected
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and any liability that cannot be excluded or limited under applicable law. If you are a consumer, you keep all mandatory rights granted to you under the laws of your country of residence, including, where applicable, Swiss consumer-protection law and the consumer rights available to users in the EU, EEA, and UK. The disclaimers and limitations in this section apply only to the extent permitted by those laws, and where any of them is found unenforceable, it applies to the maximum extent permitted instead.
10.5 Indemnity
You agree to indemnify and hold harmless Nest Apps and its operator from any claims, damages, losses, liabilities, and reasonable costs (including reasonable legal fees) arising out of or related to: your misuse of the service; your breach of these Terms or of any applicable law; content you import, upload, store, or share that you do not have the right to use; or your use of the bring-your-own-key (BYOK) and URL-import features to access, attack, or interfere with any third party or third-party service. This does not apply to the extent a claim results from our own breach or from liability that cannot lawfully be limited.
11. Suspension & termination
11.1 Ending your account yourself
You may stop using simmr at any time. Signing out from your profile ends your session on that device but does not delete any data. To delete your account and the personal data tied to it, contact us at admin@nestapps.ch and we will action the request manually. We will confirm your request and remove your account within a reasonable period, subject to data we are required to retain (see the Privacy Policy).
Some content in simmr is shared with the household group it belongs to. Deleting your account does not automatically delete a group or the recipes, plans, pantry items, shopping lists, or images stored in it; those are removed when the group itself is deleted by a group administrator. If you are the sole administrator of a group, tell us what should happen to the group's content when you request deletion.
11.2 Suspension or termination by us
We may suspend or terminate your access to simmr, in whole or in part, with or without notice where reasonably necessary, if:
- you breach these Terms, including the acceptable-use limits (for example unlawful, infringing, or abusive use, circumventing quotas, ads, or entitlement gates, or fraudulent purchases or chargebacks);
- we are required to do so by law, by a court or competent authority, or by Google or Apple under their store policies;
- it is necessary to protect the security, integrity, or availability of the service, other users, or third parties; or
- your continued use exposes us or others to legal or financial risk.
Where the issue can be fixed and it is appropriate to do so, we will try to let you know and give you a chance to put it right before terminating. To prevent abuse, a store purchase that has already been claimed by one account cannot be claimed again by another.
11.3 Effect of termination on your content
On termination, your right to use simmr ends. We may delete account data associated with you in line with the Privacy Policy. Note that records we are legally required to keep, and product-analytics records, are not deleted but are disassociated from your identity where applicable. Content stored in a household group remains with that group until the group is deleted.
11.4 Effect on subscriptions and purchases
Nest Plus subscriptions and the one-time BYOK unlock are sold and managed entirely by Google Play or the Apple App Store. Suspending, terminating, or deleting your simmr account does not, by itself, cancel an auto-renewing subscription or trigger a refund. To stop future charges you must cancel the subscription in the relevant store's subscription settings (the app links out to the Play and Apple manage-subscription pages). Refunds, where available, are handled by Google or Apple under their terms; we do not process payments and cannot issue store refunds. If we terminate your account because you breached these Terms, you may lose access to paid features without a refund, except where the store's policies or applicable law require otherwise.
12. Governing law, changes & contact
12.1 Governing law
These Terms, and any dispute arising from them or from your use of simmr, are governed by the laws of Switzerland, where Nest Apps is established, without regard to conflict-of-law rules. To the extent permitted by law, the courts at the seat of Nest Apps in Switzerland (registered address Rue Arnold-Guyot 3, 2000 Neuchâtel) have jurisdiction.
This choice of law does not deprive you of the protection of any mandatory consumer-protection rules of the country where you habitually reside. If you are a consumer in the EU, EEA, UK, or another jurisdiction whose law grants you rights that cannot be waived by contract, those rights continue to apply alongside these Terms.
12.2 Changes to these Terms
We may update these Terms from time to time, for example to reflect new features, changes to the service, or legal requirements. When we make a material change, we will update the "last updated" date at the top of this page and, where appropriate, give you reasonable notice in the app or by email.
If you continue to use simmr after a change takes effect, you accept the updated Terms. If you do not agree to a change, you should stop using the service; you can also cancel any subscription through the relevant app store (see Section 7) and request deletion of your data by contacting us.
12.3 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.
12.4 Entire agreement
These Terms, together with our Privacy Policy, make up the entire agreement between you and Nest Apps regarding simmr, and replace any prior agreements or understandings on that subject. Your use of the app is also subject to the rules of the app store through which you obtained it (Google Play or the Apple App Store), which govern billing, cancellation, and refunds.
